1. Important Definitions

Cooling-off Period: The period during which the Consumer may exercise the right of withdrawal (14 days).

Consumer: Any natural person who is not acting in the course of a profession or business and enters into a distance contract.

Right of Withdrawal: The Consumer’s right to withdraw from the contract within the cooling-off period.

Entrepreneur: The legal entity offering products and/or services to Consumers at a distance.

Distance Contract: A contract concluded using one or more means of distance communication.

3. Applicability

These Terms and Conditions apply to every offer and every distance contract between Eskey and the Consumer. Before concluding a contract, the Consumer will be provided with these Terms and Conditions.

4. The Offer

All offers are non-binding. Eskey reserves the right to modify the offer. Product descriptions are detailed to allow proper assessment. Images provide a truthful representation, though minor deviations may occur.

5. The Agreement

A contract is established once the Consumer accepts the offer and meets the stated requirements. When the acceptance is made electronically, Eskey will immediately confirm receipt of the order.

6. Right of Withdrawal

For Products:
The Consumer has the right to withdraw within 14 days after receiving the product, without providing reasons. Products must be returned undamaged and, where reasonably possible, in their original packaging.

For Services:
The Consumer may withdraw within 14 days after the agreement is concluded, unless the service has already begun with explicit Consumer consent.

7. Costs in Case of Withdrawal

Return shipping costs are paid by the Consumer. Eskey will refund the purchase amount within 14 days after receiving the returned product.

8. Exclusions of the Right of Withdrawal

• Custom-made or personalized products.
• Sealed hygiene products once the seal is broken.
• Perishable goods that deteriorate quickly.

9. Pricing

Prices include VAT and are clearly stated. Price increases within 3 months are not allowed unless required by law.

10. Conformity and Warranty

Eskey guarantees that products comply with the agreement and provided specifications. Complaints must be submitted within 4 weeks of delivery.

11. Delivery and Execution

Products are delivered to the Consumer’s provided address. Delivery times are indicative; if delayed, the Consumer will be notified within 30 days.

12. Duration Contracts and Termination

Open-ended contracts may be terminated at any time with a notice period of no more than one month.

13. Payment

Payment must be made within 7 working days after the start of the cooling-off period.

14. Complaints Procedure

Complaints can be submitted via support@eskey.nl. Eskey aims to respond within 14 days.

15. Disputes

All agreements between Eskey and the Consumer are governed exclusively by Dutch law.

16. Additional Provisions

Additional provisions may not disadvantage the Consumer and must be agreed upon in writing.
